UAE Probation Rules in 2026: What Business Owners Must Get Right Before Hiring

Updated guidance on UAE probation periods clarifies leave entitlements and resignation consequences for employers and employees alike.

# The Rules Employers Most Often Misapply

The UAE Labour Law, Federal Decree-Law No. 33 of 2021, caps probation at six months. That is not a guideline. An employer who extends a probation period beyond that threshold is in breach, regardless of what the employment contract says. Emirates 24|7 reported in September 2026 on several provisions that SME owners regularly get wrong.

Annual leave is one of them. Employees on probation do not automatically forfeit leave entitlements. If the employment contract grants leave from day one, the employer must honour it. Where the contract is silent, the standard entitlement accrues only after completing a year of service, but an employee who completes probation and continues in the role retains the right to that accrual.

# Resignation and Notice During Probation: The Cost of Getting It Wrong

The resignation rules carry the sharpest financial exposure for employers.

If an employee resigns during probation with the intention of leaving the UAE entirely, 14 days' notice is required. If they plan to join another employer inside the country, they must give 30 days' notice and the new employer is liable to bear the costs of the original employer's recruitment spend, subject to certain conditions. Many hiring managers are unaware of that second point and inadvertently expose their company to a claim when they poach staff mid-probation.

For employers terminating during probation, the minimum notice is 14 days. Termination without notice, or with notice periods shorter than those prescribed, can trigger compensation claims through the Ministry of Human Resources and Emiratisation (MOHRE).

# Arbitrary Dismissal Is Still a Live Risk on Probation

A common assumption is that probation creates an unrestricted right to terminate. It does not. The decree-law's provisions on arbitrary dismissal apply from the first day of employment. Terminating a probationer for reasons related to pregnancy, union activity, filing a complaint against an employer, or protected characteristics exposes the company to compensation up to the level prescribed under the decree-law, separate from any end-of-service calculation.

# What to Do About It

Audit existing contracts now. Any template that sets probation beyond six months is non-compliant and should be corrected before the next hire is made on that template. A contract that contradicts the decree-law is not enforceable on the non-compliant clause; it simply defaults to the statutory position, which may not be the one the employer intended.

Document termination decisions during probation. A brief written record of performance concerns, maintained in the employee's file, is the most straightforward protection against an arbitrary dismissal claim. It does not need to be a formal performance-improvement plan, but it must predate the termination notice.

Brief line managers on the notice obligation. The 30-day notice requirement for employees leaving to join a new UAE employer is operationally significant. HR teams should confirm the current employer's position before extending an offer to a candidate who is still serving probation elsewhere.

Check MOHRE-registered contracts match signed documents. Discrepancies between the MOHRE-registered contract and the version the employee signed are a common source of disputes. Both documents should reflect identical terms, particularly on probation length and notice.

Companies with high hiring volumes, particularly those in retail, hospitality or services, should run a brief compliance check across their standard employment pack before the end of the quarter.
